Simple, transparent terms for using Cup Collective.

1. Acceptance of Terms

By downloading, installing, or using Cup Collective™ ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

"Cup Collective" is a trademark of AR Capital Innovations Pty Ltd.

2. Service Description

Cup Collective™ is a digital coffee loyalty platform that connects customers with local coffee stores through a QR code-based reward system. The App enables customers to earn loyalty points and redeem rewards at participating stores.

3. Account Registration & Usage

Store Owners

  • You may create multiple accounts for different business locations
  • Use location-specific names to differentiate stores (e.g., "Coffee Shop - Melbourne CBD")
  • You are responsible for maintaining accurate and current store information
  • Each location requires a separate account for proper loyalty tracking
  • Authorised representatives (e.g., managers) may create accounts on behalf of business owners

Customers

  • Each customer should maintain one account for optimal loyalty tracking
  • Multiple accounts may result in fragmented loyalty points and fewer rewards

4. Fees & Payments

Current Pricing

  • The App is currently 100% free for both customers and stores
  • Core functionality (loyalty tracking, QR scanning, reward redemption) will always remain free

Future Features

  • We may introduce paid features in the future
  • Any paid features will be optional and will not affect core loyalty functionality
  • We will provide notice before introducing any paid features

5. Intellectual Property & Data Ownership

Your Content

  • Store Owners: You own and retain all rights to your business information (name, address, phone number)
  • Customers: You own your personal data and loyalty transaction history
  • By using the App, you grant us permission to store, process, and display your information solely to operate the loyalty program

Our Content

  • Cup Collective™ name, logo, and trademark are property of AR Capital Innovations Pty Ltd
  • App design, functionality, and proprietary systems are our intellectual property

6. Service Availability & Disclaimers

"As Is" Service

Cup Collective is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee:

  • Uninterrupted service availability
  • Error-free operation
  • Compatibility with all devices or operating systems

Limitation of Liability

We are not liable for:

  • App downtime or service interruptions
  • Lost loyalty points due to technical issues
  • Inaccurate or outdated store information
  • Business losses resulting from service unavailability

Store Responsibilities

  • Store owners are responsible for maintaining accurate business information
  • Stores must honour valid loyalty rewards presented through the App
  • Stores are responsible for their own business operations and customer service

7. Account Termination

Our Rights

We reserve the right to terminate or suspend any account at any time for any reason, including but not limited to:

  • Fraudulent activity or misuse of the platform
  • Violation of these Terms of Service
  • Inappropriate or illegal business practices
  • Extended account inactivity

Store Departure Impact

  • If a store leaves the platform, all customer loyalty points for that store are forfeited
  • Customers will not be compensated for unredeemed rewards
  • We are not responsible for refunds or compensation of any kind

8. Geographic Restrictions & Governing Law

Service Availability

  • Cup Collective is currently only available for use within Australia
  • We make no representations about the App's legality outside Australia

Legal Jurisdiction

  • These Terms are governed by and construed in accordance with Australian law
  • Any disputes will be resolved in the courts of Victoria, Australia
  • You agree to submit to the exclusive jurisdiction of Victorian courts

9. Service Changes & Updates

Platform Modifications

  • We may update, modify, improve, or discontinue Cup Collective or any features at any time without prior notice
  • We may temporarily or permanently suspend the service for maintenance or updates
  • Continued use of the App after any changes constitutes acceptance of the modified Terms

Account Data

  • We are not required to maintain or provide copies of account data after termination
  • You are responsible for backing up any important information

10. Prohibited Activities

Account Restrictions

  • You may not sell, transfer, or assign your account to any third party
  • Customer accounts may not be created on behalf of others without their consent
  • You may not use false or misleading information when registering

System Abuse

The following activities are strictly prohibited:

  • Creating fake transactions or manipulating loyalty points
  • Sharing QR codes inappropriately or gaming the reward system
  • Using the App for any illegal or unauthorised purpose
  • Attempting to gain unauthorised access to our systems or other users' accounts
  • Interfering with or disrupting the App's functionality

Consequences

  • Any fraudulent activity will result in immediate account termination
  • No refunds or compensation will be provided for forfeited loyalty points
  • We may pursue legal action for serious violations

11. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Indemnification

You agree to indemnify and hold AR Capital Innovations Pty Ltd harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

14. Severability
